Understanding the Legal Definition of Negligence in Georgia

Negligence is a foundational concept in personal injury law. In Georgia, understanding what constitutes negligence can make the difference between winning and losing a case. If you’ve been injured due to someone else’s carelessness, it’s important to understand how state law defines negligence and what you need to prove in order to recover compensation.

What Is Negligence Under Georgia Law?

Negligence occurs when a person or entity fails to exercise the level of care that a reasonably prudent person would under similar circumstances. In other words, it’s a failure to act responsibly, resulting in harm to another.

To establish a negligence claim in Georgia, the injured party (the plaintiff) must prove four essential elements:

  1. Duty of Care: The defendant owed a legal duty to the plaintiff. For example, drivers have a duty to operate their vehicles safely.
  2. Breach of Duty: The defendant breached that duty through an act or omission, such as texting while driving.
  3. Causation: The defendant’s breach directly caused the plaintiff’s injury.
  4. Damages: The plaintiff suffered actual harm or losses as a result, such as medical bills or lost wages.

Comparative Negligence in Georgia

Georgia follows a modified comparative negligence rule. This means that if you are found to be partially responsible for your injuries, your compensation may be reduced by your percentage of fault. However, if you are 50% or more at fault, you cannot recover damages.

For example, if you were found 20% at fault in an accident and awarded $100,000, your recovery would be reduced to $80,000.

Why Legal Guidance Matters

Negligence cases can be complex, involving detailed investigations, expert testimony, and strict legal deadlines. Proving fault requires strong evidence and strategic presentation. Having an experienced attorney ensures your rights are protected and your case is built on solid legal grounds.
